第一(yi)、補(bu)充(chong)勞(lao)動合(he)同(tong)與備(bei)案(an)的勞(lao)動合(he)同(tong)具備(bei)同(tong)等效力。只要雙方約定(ding)不違法,發生勞(lao)資糾紛后,仲裁委及法院(yuan)會確(que)認補(bu)充(chong)勞(lao)動合(he)同(tong)有效。此(ci)外,某(mou)些需要補(bu)充(chong)而職工也(ye)(ye)無異(yi)議的事(shi)項,也(ye)(ye)可以在(zai)企業(ye)規(gui)章(zhang)中規(gui)定(ding),但這些企業(ye)規(gui)章(zhang)應交由(you)職工閱(yue)讀(du),并(bing)要求(qiu)他們簽名確(que)認。

現在(zai)用(yong)人(ren)單位在(zai)勞動爭議案件中敗訴(su)高(gao)達80%,就(jiu)是存在(zai)上述的問題(ti)。

江(jiang)蘇(su)省目前處(chu)理勞(lao)(lao)動合(he)(he)同爭議(yi)的主要(yao)依據《江(jiang)蘇(su)省勞(lao)(lao)動合(he)(he)同條(tiao)例》,該規(gui)定傾向于勞(lao)(lao)動者,這雖然是保護弱者的需要(yao),但(dan)同時為規(gui)范市場(chang)科學管理,用人單位也需要(yao)完善。

第三(san)、勞動合同(tong)應(ying)盡量詳(xiang)細地(di)約定雙(shuang)方的(de)義務(wu)。約定雙(shuang)方義務(wu)的(de)益處(chu)既(ji)在(zai)于(yu)保證雙(shuang)方按照合同(tong)嚴格履行(xing)職責,防止出現違約情況;也在(zai)于(yu)一方違約時,能夠有明(ming)確(que)的(de)處(chu)罰依據(ju)。對于(yu)企業來講,在(zai)勞動合同(tong)中,應(ying)明(ming)確(que)職工(gong)(gong)的(de)工(gong)(gong)作崗位(wei)及其(qi)具(ju)體(ti)職責,并明(ming)確(que)對于(yu)該崗位(wei)工(gong)(gong)作的(de)具(ju)體(ti)要求。這樣,員工(gong)(gong)有違反(fan)職責的(de)行(xing)為,就有明(ming)確(que)的(de)處(chu)理依據(ju)。

第四、勞動合(he)同最好約(yue)定明確可(ke)行(xing)的(de)(de)(de)違(wei)約(yue)責任(ren)和罰則(ze)。約(yue)定違(wei)約(yue)責任(ren)和罰責,既可(ke)以(yi)起到警(jing)戒作用(yong),更能夠成為日后作出相(xiang)應(ying)處(chu)理的(de)(de)(de)有力依(yi)據,上了法庭也不(bu)需要在違(wei)約(yue)責任(ren)問題上依(yi)賴法官的(de)(de)(de)"自由裁量",為保護企業(ye)(ye)自身(shen)的(de)(de)(de)合(he)法權利(li)提供必要的(de)(de)(de)保障(zhang)。對于(yu)違(wei)約(yue)責任(ren),主要是(shi)指違(wei)約(yue)賠償責任(ren),可(ke)以(yi)由企業(ye)(ye)與職(zhi)工(gong)(gong)雙(shuang)方(fang)商定各種(zhong)違(wei)約(yue)情形(xing)下具體的(de)(de)(de)賠償數額;對于(yu)職(zhi)工(gong)(gong)違(wei)紀的(de)(de)(de)處(chu)罰方(fang)式,可(ke)以(yi)是(shi)警(jing)告、記過(guo)、扣工(gong)(gong)資、開除等。對于(yu)職(zhi)工(gong)(gong)的(de)(de)(de)違(wei)紀處(chu)罰,在勞動合(he)同中約(yue)定不(bu)可(ke)能太詳細,可(ke)引用(yong)企業(ye)(ye)規(gui)章的(de)(de)(de)規(gui)定。

第(di)五、最好約(yue)(yue)(yue)定(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)終止(zhi)的(de)(de)條(tiao)(tiao)件(jian)(jian)或(huo)者企(qi)(qi)業單(dan)方(fang)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)的(de)(de)條(tiao)(tiao)件(jian)(jian)。勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)終止(zhi)的(de)(de)條(tiao)(tiao)件(jian)(jian),指在勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)中(zhong)(zhong)約(yue)(yue)(yue)定(ding)(ding),一旦出現某些(xie)事由(you),勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)即終止(zhi),雙方(fang)不(bu)再(zai)受勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)約(yue)(yue)(yue)束;企(qi)(qi)業單(dan)方(fang)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)的(de)(de)條(tiao)(tiao)件(jian)(jian),即在勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)中(zhong)(zhong)約(yue)(yue)(yue)定(ding)(ding),如(ru)(ru)果(guo)勞(lao)(lao)(lao)動(dong)(dong)(dong)者發生某些(xie)行為(wei),企(qi)(qi)業可以單(dan)方(fang)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)而不(bu)需(xu)支(zhi)(zhi)付經(jing)(jing)(jing)濟補(bu)償金(jin)(jin)(jin)或(huo)者賠償金(jin)(jin)(jin)。但應(ying)注(zhu)意,不(bu)能把法(fa)定(ding)(ding)的(de)(de)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)而需(xu)支(zhi)(zhi)付經(jing)(jing)(jing)濟補(bu)償金(jin)(jin)(jin)的(de)(de)情形(xing),也約(yue)(yue)(yue)定(ding)(ding)在勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)中(zhong)(zhong)并規定(ding)(ding)不(bu)需(xu)支(zhi)(zhi)付經(jing)(jing)(jing)濟補(bu)償金(jin)(jin)(jin)。約(yue)(yue)(yue)定(ding)(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)終止(zhi)或(huo)者企(qi)(qi)業單(dan)方(fang)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)的(de)(de)條(tiao)(tiao)件(jian)(jian)的(de)(de)好處在于:一旦有約(yue)(yue)(yue)定(ding)(ding)情形(xing)出現,企(qi)(qi)業就可以不(bu)再(zai)履行勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong),而不(bu)需(xu)支(zhi)(zhi)付經(jing)(jing)(jing)濟補(bu)償金(jin)(jin)(jin)。比如(ru)(ru)某公司(si)約(yue)(yue)(yue)定(ding)(ding):職工(gong)當月無(wu)故曠(kuang)工(gong)2天,企(qi)(qi)業可以解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)而不(bu)支(zhi)(zhi)付補(bu)償金(jin)(jin)(jin)。如(ru)(ru)果(guo)按照法(fa)律規定(ding)(ding),職工(gong)曠(kuang)工(gong)2天,顯然不(bu)太可能被認為(wei)是"嚴(yan)重(zhong)"違反企(qi)(qi)業規章。如(ru)(ru)果(guo)沒有上述約(yue)(yue)(yue)定(ding)(ding),企(qi)(qi)業以此解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)(he)同(tong)(tong)(tong)很(hen)可能被判賠償。

第六、以(yi)職工"辭(ci)(ci)職"取代企業(ye)";解除"。避免辭(ci)(ci)退(tui)補償(chang)金(jin)糾紛(fen)的發生。根據勞動(dong)法的規定,員(yuan)工自動(dong)辭(ci)(ci)職的,企業(ye)不需(xu)支付辭(ci)(ci)退(tui)補償(chang)金(jin)。在某些情(qing)況(kuang)下(如員(yuan)工為(wei)日后(hou)尋找工作方(fang)便不愿被"開(kai)除"),員(yuan)工違(wei)紀后(hou)愿意以(yi)"辭(ci)(ci)職"名義離(li)開(kai)企業(ye)。在這(zhe)種情(qing)況(kuang)下,企業(ye)如果能取得(de)員(yuan)工的辭(ci)(ci)職書,就(jiu)可(ke)不必支付辭(ci)(ci)退(tui)補償(chang)金(jin)。

第(di)七、勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)。如(ru)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)期滿終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)后不再(zai)續簽(qian),為避免不必(bi)要的(de)(de)(de)(de)(de)糾紛的(de)(de)(de)(de)(de)發生,企(qi)業(ye)應(ying)在(zai)期滿日之前30日,以書面方(fang)式并(bing)要求(qiu)員工(gong)簽(qian)收(shou)通(tong)知(zhi)該(gai)員工(gong)終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)合(he)同(tong)(tong)(tong)(tong)。在(zai)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)中(zhong)(zhong)約(yue)定(ding)(ding)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)(de)(de)終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)條(tiao)(tiao)件(jian)。根據勞(lao)(lao)動(dong)(dong)法的(de)(de)(de)(de)(de)規(gui)(gui)定(ding)(ding),勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)中(zhong)(zhong)約(yue)定(ding)(ding)的(de)(de)(de)(de)(de)終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)條(tiao)(tiao)件(jian)出(chu)現(xian)時(shi)(shi),勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)即終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)。因終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)條(tiao)(tiao)件(jian)出(chu)現(xian)而終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)時(shi)(shi),同(tong)(tong)(tong)(tong)樣不需要支(zhi)付(fu)(fu)辭(ci)退補償金(jin)。如(ru):在(zai)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)中(zhong)(zhong)約(yue)定(ding)(ding)"停工(gong)待(dai)料日期超過XX日,且(qie)不可能(neng)立即恢復生產的(de)(de)(de)(de)(de),本(ben)合(he)同(tong)(tong)(tong)(tong)終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)"。 應(ying)注(zhu)意的(de)(de)(de)(de)(de)是,對于勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)條(tiao)(tiao)件(jian)的(de)(de)(de)(de)(de)約(yue)定(ding)(ding)不能(neng)違(wei)法,不能(neng)把法定(ding)(ding)應(ying)支(zhi)付(fu)(fu)辭(ci)退補償金(jin)的(de)(de)(de)(de)(de)情(qing)形,規(gui)(gui)定(ding)(ding)為終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)(de)(de)條(tiao)(tiao)件(jian)。如(ru):類似"員工(gong)不能(neng)勝(sheng)任工(gong)作,經(jing)培(pei)訓和換崗后仍不能(neng)勝(sheng)任工(gong)作的(de)(de)(de)(de)(de),勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)(tong)終(zhong)(zhong)(zhong)(zhong)止(zhi)(zhi),企(qi)業(ye)不支(zhi)付(fu)(fu)經(jing)濟補補償金(jin)"的(de)(de)(de)(de)(de)規(gui)(gui)定(ding)(ding),就因為違(wei)法而不發生效力。

第(di)八(ba)、在勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)及企(qi)業(ye)(ye)規(gui)(gui)(gui)章(zhang)(zhang)中(zhong)明確規(gui)(gui)(gui)定(ding)違(wei)紀(ji)辭(ci)(ci)退的(de)(de)情(qing)(qing)形(xing)。通過(guo)(guo)有(you)(you)效引用過(guo)(guo)錯辭(ci)(ci)退條(tiao)款(kuan),預防和解決(jue)辭(ci)(ci)退補(bu)償金糾(jiu)(jiu)紛(fen)。根據(ju)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)法及甘肅省勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)條(tiao)例有(you)(you)關規(gui)(gui)(gui)定(ding),員(yuan)工有(you)(you)下列(lie)情(qing)(qing)形(xing)之一(yi)的(de)(de),用人單位(wei)可(ke)以(yi)隨(sui)時(shi)解除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong),且不(bu)(bu)需(xu)支付(fu)辭(ci)(ci)退補(bu)償金:(一(yi))試用期內證明不(bu)(bu)符合(he)(he)(he)錄(lu)用條(tiao)件;(二)嚴(yan)(yan)重(zhong)違(wei)反勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)紀(ji)律或(huo)(huo)者(zhe)用人單位(wei)規(gui)(gui)(gui)章(zhang)(zhang)制度;(三)嚴(yan)(yan)重(zhong)失(shi)職,營(ying)私舞(wu)弊,對用人單位(wei)利益造成重(zhong)大(da)損(sun)(sun)害的(de)(de);(四)被(bei)(bei)依(yi)法追究刑事(shi)責(ze)任及被(bei)(bei)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)教養的(de)(de)。在辭(ci)(ci)退糾(jiu)(jiu)紛(fen)中(zhong),上(shang)述(二)、(三)項(xiang)是經常被(bei)(bei)企(qi)業(ye)(ye)引為(wei)辭(ci)(ci)退理(li)由的(de)(de)。但在司法實踐(jian)中(zhong),這兩項(xiang)的(de)(de)標(biao)準都難以(yi)掌握。什么是"嚴(yan)(yan)重(zhong)"違(wei)紀(ji),多大(da)損(sun)(sun)害才(cai)算"重(zhong)大(da)",都是十(shi)分(fen)模糊的(de)(de)標(biao)準。如果交由勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)仲裁(cai)委(wei)員(yuan)會(hui)或(huo)(huo)者(zhe)法院去(qu)判斷,大(da)多數(shu)(shu)的(de)(de)違(wei)紀(ji)行為(wei)不(bu)(bu)會(hui)被(bei)(bei)認為(wei)是"嚴(yan)(yan)重(zhong)",大(da)多數(shu)(shu)的(de)(de)損(sun)(sun)害不(bu)(bu)會(hui)被(bei)(bei)認定(ding)為(wei)"重(zhong)大(da)"。因此,在這種情(qing)(qing)況(kuang)下,大(da)多數(shu)(shu)企(qi)業(ye)(ye)面(mian)(mian)臨敗(bai)訴的(de)(de)局面(mian)(mian)。但如果企(qi)業(ye)(ye)在其勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)或(huo)(huo)者(zhe)規(gui)(gui)(gui)章(zhang)(zhang)制度中(zhong)明確規(gui)(gui)(gui)定(ding)辭(ci)(ci)退且不(bu)(bu)支付(fu)補(bu)償金的(de)(de)情(qing)(qing)形(xing),只要這些規(gui)(gui)(gui)定(ding)不(bu)(bu)違(wei)法,發生糾(jiu)(jiu)紛(fen)后,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)仲裁(cai)委(wei)員(yuan)會(hui)和法院一(yi)般(ban)就會(hui)依(yi)照企(qi)業(ye)(ye)規(gui)(gui)(gui)章(zhang)(zhang)的(de)(de)規(gui)(gui)(gui)定(ding)作出裁(cai)決(jue)。在勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)或(huo)(huo)者(zhe)企(qi)業(ye)(ye)規(gui)(gui)(gui)章(zhang)(zhang)制度中(zhong)規(gui)(gui)(gui)定(ding)辭(ci)(ci)退條(tiao)件,可(ke)以(yi)有(you)(you)以(yi)下幾種方式:

1.單獨對辭(ci)退(tui)條件作(zuo)規定。如(ru)有(you)的單位規章就(jiu)規定:"員工有(you)以下行為之一(yi)的,立即(ji)予以辭(ci)退(tui),并不支付(fu)經(jing)濟(ji)補償金:1.……"。

2.在具體守則中規定。如:"員(yuan)工不(bu)能正(zheng)常上(shang)班應請(qing)假,未按程序請(qing)假的視為曠工。曠工3天以(yi)上(shang)的,予(yu)以(yi)辭退,并(bing)不(bu)支付經(jing)濟(ji)補(bu)償金。"

3.對(dui)于(yu)某些違(wei)紀行(xing)(xing)為雖然性質較輕,但如(ru)(ru)(ru)果屢教不改,也應當規定為辭退(tui)條(tiao)(tiao)件。具體(ti)規定的(de)方(fang)式可以(yi)(yi)有(you)3種(zhong):1)就(jiu)單個(ge)行(xing)(xing)為累(lei)計,如(ru)(ru)(ru):"無(wu)故遲(chi)到或(huo)者早退(tui),在一(yi)個(ge)月(yue)內(nei)累(lei)計達到10次,或(huo)者1年中達到50次以(yi)(yi)上(shang)者,予(yu)以(yi)(yi)辭退(tui),并不支(zhi)付(fu)經(jing)濟(ji)(ji)補(bu)償(chang)金(jin)(jin)。" 2)累(lei)計處(chu)罰方(fang)式,如(ru)(ru)(ru):"一(yi)個(ge)月(yue)內(nei)累(lei)計受到警告以(yi)(yi)上(shang)處(chu)分5次以(yi)(yi)上(shang)者,三個(ge)月(yue)內(nei)……予(yu)以(yi)(yi)辭退(tui)……"。 3)逐步加重式,如(ru)(ru)(ru)"弄虛作假,托他(ta)人代打工卡者,初次發(fa)現扣除工資(zi)50元,再次發(fa)現,即予(yu)辭退(tui),并不支(zhi)付(fu)經(jing)濟(ji)(ji)補(bu)償(chang)金(jin)(jin)"。   4.由(you)于(yu)企業的(de)勞動合同和規章(zhang)不可能對(dui)所有(you)違(wei)紀行(xing)(xing)為都(dou)詳(xiang)盡列(lie)舉(ju),因此還(huan)需要:1)規定類(lei)比情形(xing)條(tiao)(tiao)款,如(ru)(ru)(ru):"……對(dui)于(yu)其(qi)他(ta)違(wei)紀行(xing)(xing)為,公司可以(yi)(yi)根據其(qi)性質參照本條(tiao)(tiao)予(yu)以(yi)(yi)處(chu)罰。" 2)及(ji)時(shi)對(dui)規章(zhang)制度進行(xing)(xing)修改,并以(yi)(yi)適當方(fang)式告知(zhi)員(yuan)工。

5.有關條款可以參照《企業獎懲條例》和《國營企業辭(ci)退(tui)違紀(ji)職工規定(ding)》(見附件)制定(ding)。

6.對于上述的辭退條件,建議(yi)都附加"不支付經(jing)濟補償(chang)金"、"不予補償(chang)"等字句,以減少(shao)爭議(yi)。

第九、過錯辭(ci)退中有(you)關(guan)(guan)證(zheng)據的(de)(de)保(bao)全和收(shou)集。在辭(ci)退補償金糾紛中,若(ruo)企(qi)業以(yi)嚴重違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)或者嚴重失職的(de)(de)理由辭(ci)退員(yuan)(yuan)工(gong),一旦糾紛發(fa)生,企(qi)業必須對職工(gong)的(de)(de)嚴重違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)和嚴重失職行為(wei)(wei)舉證(zheng),因此(ci),保(bao)全和收(shou)集證(zheng)據至為(wei)(wei)重要(yao)。企(qi)業所要(yao)保(bao)全和收(shou)集的(de)(de)證(zheng)據,主要(yao)是(shi)兩類(lei):其(qi)一是(shi)員(yuan)(yuan)工(gong)所違(wei)(wei)(wei)反的(de)(de)企(qi)業規(gui)章(zhang)及勞動紀(ji)(ji)(ji)(ji)(ji)律的(de)(de)具體條款;其(qi)二(er)是(shi)員(yuan)(yuan)工(gong)的(de)(de)違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)行為(wei)(wei)。通常,可以(yi)證(zheng)明員(yuan)(yuan)工(gong)違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)行為(wei)(wei)的(de)(de)證(zheng)據主要(yao)有(you):1)違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)員(yuan)(yuan)工(gong)的(de)(de)"檢討書(shu)(shu)"、"求情書(shu)(shu)"、"申(shen)辯書(shu)(shu)"、違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)情況說明,等等;2)有(you)違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)員(yuan)(yuan)工(gong)本人簽字的(de)(de)違(wei)(wei)(wei)紀(ji)(ji)(ji)(ji)(ji)記錄;3)其(qi)他員(yuan)(yuan)工(gong)及知情者的(de)(de)證(zheng)明;4)有(you)關(guan)(guan)物證(zheng);5)有(you)關(guan)(guan)書(shu)(shu)證(zheng)及視聽資料;6)政府(fu)有(you)關(guan)(guan)部門的(de)(de)處(chu)理意見、處(chu)理記錄及證(zheng)明等。

司(si)法實踐中,有(you)(you)違(wei)(wei)紀(ji)(ji)員(yuan)工(gong)(gong)(gong)簽(qian)字(zi)的(de)書面(mian)材(cai)(cai)料,往(wang)往(wang)是(shi)勞動爭議仲裁(cai)委員(yuan)會和法院樂于(yu)采納的(de)最有(you)(you)力(li)的(de)證(zheng)據(ju)。因(yin)此,企(qi)(qi)業在(zai)辭退職工(gong)(gong)(gong)之前,應(ying)(ying)盡(jin)量取得有(you)(you)違(wei)(wei)紀(ji)(ji)員(yuan)工(gong)(gong)(gong)簽(qian)字(zi)的(de)書面(mian)材(cai)(cai)料。對(dui)(dui)于(yu)有(you)(you)違(wei)(wei)法行為(wei)(wei)(如賭博(bo)、盜竅等)的(de)員(yuan)工(gong)(gong)(gong),可(ke)(ke)以要求(qiu)政(zheng)府(fu)有(you)(you)關部(bu)門處(chu)理,政(zheng)府(fu)有(you)(you)關部(bu)門的(de)處(chu)理結論或者記錄(lu),就可(ke)(ke)能是(shi)有(you)(you)力(li)的(de)證(zheng)據(ju)。對(dui)(dui)于(yu)"大錯不犯(fan),小錯不斷(duan)"的(de)員(yuan)工(gong)(gong)(gong)的(de)違(wei)(wei)紀(ji)(ji)行為(wei)(wei),應(ying)(ying)注意平(ping)時記錄(lu)在(zai)案。每次(ci)違(wei)(wei)紀(ji)(ji)時,企(qi)(qi)業都作出(chu)相應(ying)(ying)的(de)書面(mian)處(chu)理材(cai)(cai)料,要求(qiu)員(yuan)工(gong)(gong)(gong)簽(qian)字(zi);為(wei)(wei)記錄(lu)方便,也(ye)可(ke)(ke)以采取扣工(gong)(gong)(gong)資(zi)(zi)的(de)處(chu)理方式(shi),在(zai)每次(ci)的(de)工(gong)(gong)(gong)資(zi)(zi)單中扣除(chu)相應(ying)(ying)的(de)工(gong)(gong)(gong)資(zi)(zi)數額,并注明(ming)違(wei)(wei)紀(ji)(ji)事由,由員(yuan)工(gong)(gong)(gong)在(zai)領(ling)取工(gong)(gong)(gong)資(zi)(zi)時簽(qian)字(zi)確認。

第十(shi)、關于企(qi)業的管理制度(du)。對(dui)于企(qi)業規(gui)章及勞動(dong)紀律,除應盡量詳細地制定(ding)條款(kuan)外,還應以適當方(fang)式(shi)告知職工(gong)(gong),建議(yi)企(qi)業在制定(ding)和公(gong)布(bu)規(gui)章制度(du)時(shi),交由員工(gong)(gong)閱讀(du),并由員工(gong)(gong)簽字確認。如果在勞動(dong)合同(tong)期(qi)間,企(qi)業規(gui)章制度(du)進行修(xiu)改(gai)的,也應再次交由員工(gong)(gong)閱讀(du)并確認。這(zhe)樣(yang),一旦糾紛(fen)發(fa)生,就不會出現(xian)員工(gong)(gong)否認有此規(gui)定(ding)的情況。
